The eDivorce Process

The eDivorce Process

Online:

  •  STEP 1 - Do you qualify?
    By completing a short questionnaire we will be able to tell you if you qualify for the eDivorce process.
  •  STEP 2 - Pay R950.00 (inclusive of VAT)
    Pay R 950 (incl. of VAT) and proceed to Step 3.
  •  STEP 3 - Complete the detailed Questionnaire
    Complete a set of detailed questions and we will generate your divorce documents. This process can take approximately 25min.
  •  STEP 4 - We generate your documentation online so that you can finalise your divorce in court
    After Step 3, your divorce documents will be generated by our system it will be checked for accuracy and made available to you so that you can print them.

Offline:

     First make sure this is an uncontested matter, i.e. that you spouse do not intend to defend it.

     Begin at Step 1 and let us test if you qualify for an eDivorce.

     If you do qualify proceed to Steps 2 - 4 (on the eDivorce webpage).

     Once you concluded Step 3 we will make your documentation available and you can print the generated divorce documentation, we also include a step-by-step checklist for your convenience.

     Both you and your spouse will need to sign the Deed of Settlement.

     The Defendant needs to sign the Notice of No Defence.

     Make the necessary copies of all documents.

     Go to Court to issue your Summons and annexures at the Registrar of court (we will inform you which court in your area you need to go to).

     Once the papers are issued at court, you will need to take the documents to the sheriff of the Court for service on the Defendant. Costs to serve the documents are approximately between R100 - R200. It is advisable that both you and your spouse go to the sheriff's office to speed up the serving of the documents so that the sheriff can serve it on the Defendant, if not the sheriff will serve it at the Defendants work or residence. Note: This is the steps you take when there are no minor children involved.

     Where there are minor children involved. Go to the Family Advocate in your area to endorse the Deed of Settlement.

     Count 10 (20 working days if your spouse lives outside the area of jurisdiction of the court) working days after the date of service on your spouse. Exclude the 1st day and include the last day, note Sundays, Saturdays and Public Holidays should not be included.

     Go back to Court (Registrar) and request a date for the hearing.

     Appear in court on that date given to you by the Registrar.
