eDivorce – Easy Online Service

A divorce process in which the parties agree, they only need to file the divorce petition and related documents, as well as reacg a settlement agreement with the court. This is a self-managed process, which is easy and inexpensive.

Divorce – Uncontested

In South Africa we have a ‘no fault’ system of divorce, meaning that a divorce will be granted if one of the parties believes that there has been an ‘irretrievable breakdown of the marriage relationship’ and that there are no reasonable prospects of restoring it.

Therefore, a marriage can be dissolved even if one of the parties does not wish to get divorced.

A default divorce is a form of uncontested divorce.  A court will grant a divorce by default if you serve a divorce summons on your spouse and he/she does not respond. In our uncontested divorce package, the plaintiff prepares a summons setting out his/her claims with help of an attorney.

International Divorce

A Partly International Divorce is when one of the spouses do not reside in South Africa, but their marital status is bound by RSA law. In our Partly International Divorce package, the plaintiff prepares a summons setting out his/her claims with help of an attorney that will assist in navigating the intricacies of a divorce where not all parties reside in South Africa.

Divorce – Contested

A contested divorce is when the spouses cannot arrive at an agreement on one or more key issues in order to conclusively terminate their marriage. When spouses cannot arrive at an agreement, even with the assistance of their legal counsel (if any), they must approach a court to adjudicate their dispute.

Due to the varied nature of a contested divorce, a flat rate fee is not available. Please contact us directly should you wish us to help you with a Contested Divorce.
