A divorce process in which the parties agree, they only need to file the divorce petition and related documents, as well as reacg a settlement agreement with the court. This is a self-managed process, which is easy and inexpensive.
In South Africa we have a ‘no fault’ system of divorce, meaning that a divorce will be granted if one of the parties believes that there has been an ‘irretrievable breakdown of the marriage relationship’ and that there are no reasonable prospects of restoring it.
Therefore, a marriage can be dissolved even if one of the parties does not wish to get divorced.

A contested divorce is when the spouses cannot arrive at an agreement on one or more key issues in order to conclusively terminate their marriage. When spouses cannot arrive at an agreement, even with the assistance of their legal counsel (if any), they must approach a court to adjudicate their dispute.
